                            Mashpee Town Hall Meeting Room 1 &2

Commissioners Present:  Ralph Shaw (Chair), Jeff Cross, Lloyd Allen, and John Rogers

Staff Present:  Steven Solbo, Conservation Agent

Chairman Ralph Shaw called the order at 6:55 p.m.

PUBLIC COMMENTS: None

POST HEARING AGENDA:

1. Land Purchase: Shields Property, decision was made to continue a formal vote until more Commissioners were present.

2.      RFAA: SE 43-2432: Brief discussion about the addition of grill, generator, and extended parking in the front of the home, Motion made and unanimously approved.

3.        Minutes of the April 15, 2007, meeting were approved.

4.       AFCEE/Selectmen: Discussion about meeting with BOS on May 14th to discuss the reimbursement that has been brought forth for FY 2006.  Steve is checking into the possibility that the Commissioners be able to meet beforehand to discuss a stance, once and for all.

7:00 PM – MA Department of Conservation and Recreation, South Cape Beach, Great Oak Road (replace 2 culverts and will restore degraded salt marsh)
Jeffery Oakes representing CLE Engineering, Mr. Oakes talked about the proposed culvert improvements on the 2 access roads to South Cape Beach.  Mr. Oakes stated that a bridge type culvert will be placed on the state access way, and that a box culvert would be placed on the Town owned access way.  Agent Steve Solbo, recommended closing and issuing an order of conditions.  

Motion made, seconded and unanimously approved.

7:03 PM – Willowbend Glen Condominium Association, Willowbend Pond (implementation of an Aquatic Vegetation Management Program for the control of problematic densities of submersed vegetation)
Keith Gazaille representing Aquatic Control.  Steve talked about how this project has been going on for 3 years now, and they are “re-upping” their RDA.  Steve also explained how this is a man-made pond and that the only area of jurisdiction is the natural BVW that surrounds the pond.  Steve then recommended a Negative Determination.

Motion made, seconded, and unanimously approved.

7:06 PM – Jamie Miller, 105 Popponesett Island Road, (construct 2 small additions to the existing house and other interior renovations)
Jennifer Malilla, representing the applicant.  Jennifer introduced the project, and described the 2 small additions as well as the grading that would need to be done to accommodate the construction.  Steve added that this is flood zone, about 200-300’ from the water, he then recommended a negative determination.

Motion made, seconded and unanimously approved.

7:09 PM – Paul Boucher, 196 Monomoscoy Road, (remodel existing dock within same footprint)
Mark Burtis representing the applicant.  Mark explained that he is simply rebuilding the dock that is in serious disrepair.  Steve went on to talk about how this fits right in line with dock filings as we request that RDA’s be pulled for dock maintenance, and this is right in the same type of filing as it would be if it were a NOI repair.  Steve recommended a Negative Determination.

Motion made, seconded and unanimously approved.

7:12 PM – Paula Larkin, 64 Wheeler Road (remove failed septic system and install new Title V septic system)
Steve Palumbo representing the applicant.  Steve Solbo asked Mr. Palumbo about how many trees would have to be removed as a result of the upgrade.  Mr. Palumbo said, “A couple, maybe 1 or 2.” After looking closely at the location of the leech field, Steve had no more questions as it was deemed out of the Commission’s jurisdiction.  Steve then recommended a negative determination.

Motion made, seconded, and unanimously approved.

7:15 PM – Briarwood – Mashpee Association Inc., (add approximately 175 yards of new sand to the existing beach at John’s Pond)
Janet Burns representing the applicant.  Steve talked briefly about the condition that the sand be left at least 4 feet away from MHW, the applicant agreed.  Steve also talked about how this permit had been issued before, about 3 years ago, that’s why the association is back in front of the commission. Steve recommended a negative determination.

Motion made, seconded and approved, unanimously.

7:18 – Nancy and Richard Cook, 401 Monomoscoy Road (Cont. from 4/19/07)
Continued to 5-17-07 @7:00 p.m. at the request of the applicant.

Motion made, seconded and approved to grant continuance.

7:21 – KeySpan Energy Delivery, 29 Frog Pond Close (install a 2” plastic gas main from the existing main and a service)
Coastal Engineering representing the applicant.  Steve let the consultant speak about the methodology and the resource areas that were close to the project.  Steve after listening to the consultant recommended that the project be approved with a negative determination.

Motion made, seconded and unanimously approved.

7:24 – John Reardon, 55 Amy Brown Road (construct and maintain in perpetuity a stairway to the edge of the salt marsh)
John Slavinsky representing the applicant, Steve got into a discussion about how this project falls with the Waquoit Bay ACEC, he went on to explain how the regulations specifically exempt this type of project within the Mashpee Town By-Law and that if it doesn’t impact the performance standards of coastal bank then the project will not have an adverse impact on ACEC either.  Steve recommended that the commission Close and Issue an order of conditions.

Motion made, seconded, and unanimously approved.

7:27 Ed Govoni, 12 Quinapen Road, (demolish building and shed and construct a new single family home with associated appurtenances)
Continued to 5-17-07 @ 7:03 at the request of the applicant.

Motion made, seconded and unanimously approved.


After a brief discussion about meeting in a group to discuss AFCEE matters, the meeting was adjourned and was not sent into executive session.
